By booking a class or course you are accepting these terms and conditions and agree to be bound by them.
These terms and conditions govern your use of our website. By using our website, you are accepting these terms and conditions in full.

All content on this website is owned by, or licensed to, The City Workshop Edinburgh and is protected by copyright. Information, images, documentation both written and visual, or any other material on this site may not be copied or reproduced in any form
All information is correct at time of publication. While every effort is made to offer the courses set out in our literature and on this website, we reserve the right to withdraw particular courses and to change both the content and the pricing of a course when need arises, without prior warning. Participants who have already paid in full for a course will not be subject to any such price increase. Minor changes of course content will not be considered to affect our refund and cancellation policy.
Definitions
The terms “we”, “us”, “our” refer to The City Workshop Edinburgh, employees and instructors.
These terms and conditions shall also apply to any person attending a class/course including any person that is the recipient of a gift voucher, any person attending a class/course booked by another or a person that attends a class in substitution for the person that made the booking, and references to “you” are deemed to include references to such attendee(s).
If you book a place on a Children’s Class, you must ensure that both you and the participant can abide by these terms and conditions.
Services
The class fee will include the services outlined in the Class Details on our website.
All materials and equipment are provided for every class, unless otherwise stated in the Class Details. In some classes there is an option to purchase further materials to enhance your piece; this is entirely optional.
Where stated in the Class Details, tea, coffee and snacks are provided. We will not cater for your specific dietary requirements and you are welcome to bring your own food.
Unless specified in the Class Details on our website as a Children’s Art Class, we do not accept enrolments from anyone under 16 years of age.
If you have any specific needs you must inform us in advance as not all classes are suitable.
Participation in our classes will not result in any type of qualification.
Price and Payment Terms
Prices for classes and courses are identified on the Class Details page of our website.
All classes must be paid in full at the time of booking unless otherwise stated. Your place is not guaranteed until full payment has been made.
You can pay for a class through our website via our payment service providers, by card over the phone, or by card or cash in person.
Refunds & Cancellation
If you cancel your booking 6 weeks before the class, you will receive a refund minus a £25 administration charge. In the instance that a class/course includes providing you with your own art materials and equipment, and these have been posted or given to you, a further £30 will be deducted from your refund to cover the cost of these materials.
If you cancel less than 6 weeks before the class, we do not offer any refund and will retain 100% of your payment.
Your non-attendance of the class due to illness or personal circumstances does not provide the right to a refund or credit.
Termination
We reserve the right to cancel a class. Reasons for this may be, but not restricted to, weather warnings and tutor illness. If your class is cancelled by us, you will be able to book another class of equal value or receive a refund of the cost of the class. We shall not be liable for any other consequential loss.
Some of our classes/courses require a minimum number of enrolments. Where the courses do not reach the minimum number required, they may be cancelled no later than 7 days before they are due to start. In this circumstance you will be able to book another class of equal value or receive a refund of the cost of the class. We shall not be liable for any other consequential loss.
If you fail to comply with our instructions and health and safety rules you will be unable to participate in the class and will be asked to leave the class immediately. In this circumstance we do not offer any refund and will retain 100% of your payment. We shall not be liable for any other consequential loss.
You must comply with all rules and regulations issued by us/your instructor and please pay attention to any requirements as to dress or the wearing of protective equipment. You are always required to participate and remain with the tutored group. You cannot opt out of field trips where they are part of the course.
If we in our sole and absolute discretion, consider that you have behaved in an unacceptable manner then we reserve the right to require you to leave the course/event immediately. All students are expected to conduct themselves in a reasonable manner and in accordance with our rules and regulations and to recognise that other students also require support and assistance. In this circumstance we do not offer any refund and will retain 100% of your payment. We shall not be liable for any other consequential loss.
Photographs
You are welcome to take photos of your artwork progress throughout the class. You need to obtain the verbal permission of other students and your instructor to take photos of other’s work.
Your instructor may take photos/film of the class. These photos may or may not be used for marketing purposes including (but not limited to) use in websites, social media, blogs, advertising, print media and more. If you do not wish to be in photos from the class or you do not wish to give your consent for your images to be used for marketing purposes, then it is your responsibility to inform your instructor at the start of the class. Failure to notify your instructor will mean your acceptance of these terms. Copyright in any photographs or audio-visual media containing your image or likeness shall belong to us and shall not entitle you to receive any royalties or other payments.
In the case of Children’s Classes, written permission from the Parent/Guardian will be sought before taking photographs of children under 16.
Insurance
We recommend that you take out insurance to cover for eventualities and cover against loss of fees through illness or personal accident. Your personal property is carried at your own risk and no responsibility can be taken for loss or damage.
Limitation of Liability
The City Workshop Edinburgh accepts no liability (whether or not losses or damage were foreseen, direct, foreseeable, known or otherwise) for loss, damage, delay, inconvenience, (including but not limited to, loss of revenue; loss of actual or anticipated profits (including without limitation loss of profits on contracts); loss of the use of money; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to or corruption of data; or any indirect, special or consequential loss or damage) however caused, unless due to our negligence in which case our liability is limited to a maximum of the participant's fee for the class undertaken.
Your personal items are your responsibility. We will not accept responsibility for the loss or damage of any personal possessions.
Classes can result in paint or other materials getting on clothing and personal items. We advise you to wear old clothes to all classes. We take no responsibility for damages incurred in classes.
Any outdoor trips are completely at the participants own risk.
The City Workshop Edinburgh will not be liable for any loss suffered by you resulting from any course or event which is beyond our reasonable control including but not limited to acts of God, wars, riots, civil commotions, malicious damage, compliance with any law or governmental order, rules, regulations or directions, accidents, breakdowns of plant or machinery, fires, floods, extreme weather, pandemics, epidemics or other outbreaks of disease or infection, or failure in the supply of electricity, heating, lighting or telecommunications equipment.
The City Workshop Edinburgh, or any party (whether or not involved in creating, producing, maintaining or delivering this website), exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in delict (including without limitation negligence), contract or otherwise) in connection with this website in any way or in connection with the use or the results of use of this website, any websites linked to this website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this website or your downloading of any material from this website or any websites linked to this website.
If your use of material on this website results in the need for servicing, repair or correction of equipment, software or data, you assume all the costs thereof.
Online & Virtual Classes & Courses
In addition to the terms above, the following terms and conditions apply to online and virtual classes.
The class/course fee will include the services and content outlined in the Class Details specific to each class/course.
Class/course content may include (but is not restricted to) written content, worksheets, images, pre-recorded lessons, live recorded lessons, social media content and Q&A sessions.
Each class/course description will define the length of time for which you have access to class/course materials and content. After this time has elapsed you will not have access to the class/course materials and content.
All class/course content is only for the use of the class/course participants who have paid for the class/course. You may not share class/course content with anyone else. Sharing of class/course content without permission will result in you losing access to the class/course content and materials. In this circumstance we do not offer any refund and will retain 100% of your payment. We shall not be liable for any other consequential loss.
All children under the age of 16 must be supervised by a parent/guardian.
All activities are undertaken at your own risk. The City Workshop Edinburgh accepts no liability (whether or not losses or damage were foreseen, direct, foreseeable, known or otherwise) for loss, damage, delay, inconvenience, (including but not limited to, loss of revenue; loss of actual or anticipated profits (including without limitation loss of profits on contracts); loss of the use of money; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to or corruption of data; or any indirect, special or consequential loss or damage) however caused.
It is your responsibility to read and follow the instructions of the materials and equipment you use. We do not accept liability for any loss, damage, delay or inconvenience caused by your use of materials and equipment.
The City Workshop Edinburgh, or any party (whether or not involved in creating, producing, maintaining or delivering online & virtual content), exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in delict (including without limitation negligence), contract or otherwise) in connection with our online & virtual content in any way or in connection with the use or the results of use of our online & virtual content, any websites linked to our online & virtual content or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this website or your downloading of any material from our online & virtual content or any websites linked to our online & virtual content.
If your use of material or our online & virtual content results in the need for servicing, repair or correction of equipment, software or data, you assume all the costs thereof.

Governing Law
These terms and conditions shall be governed by and construed in accordance with Scots Law and are subject to the exclusive jurisdiction of the Scottish courts.
